Queensland dad pleads guilty to incest with his 20-year-old daughter after the estranged pair connected on Facebook – and she ‘instigated’ the consensual acts

A Gold Coast father has pleaded guilty to two counts of incest with his estranged daughter after the pair reconnected online. 

The daughter was 20 while the father was 47 when they connected via Facebook and later shared explicit messages in March and April 2019 before engaging in sexual intercourse.  

Judge Geraldine Dann sentenced the man to 12months in prison on Monday and described the incidents as ‘brief, totally non-violent, consensual and to some degree ‘instigated by the daughter’.

The Southport District Court was told the pair had become estranged when the girl was five years old, but reconnected online 15 years later.

The washing machine repairman would pick up his daughter from Ipswich, west of Brisbane, and travel to the Gold Coast where they booked a hotel. 

The father told police he knew their behavior was wrong once they engaged in sexual intercourse, the Gold Coast Bulletin reported. 

They also shared sexually explicit messages but Crown prosecutor Gary Churchill told the court ‘it is an unclear situation’ on who initiated the conversations. 

‘There doesn’t seem there is any real manipulation by this defendant,’ he said.  

After the two incidents, the daughter sent screenshots of the pair’s messages to her father’s sister and ‘made plans to meet a second time’ with the man.

‘The offending was consensual on both sides but she appeared to have been distressed about it,’ Mr Churchill said.    

Defence barrister John McInnes said the dad ‘knew what he was doing was wrong and behaved impulsively’ and was undergoing treatment for mental health issues. 

The woman was sentenced in Ipswich last year for incest and other unrelated sexual offences to three years in prison.
